The short version. The beta is free, pre-release software for evaluation. It does not make or receive phone calls. Your agents are private to your account. Please test with made-up information — not real customer, health, payment, or ID data. We don't train AI models on your content. This summary is for orientation only; the terms below are what govern.
1. Agreement to these Terms
These Beta Terms of Service (“Terms”) are a binding agreement between you and Kindred PM, Inc., a corporation doing business as Kindred Voice (“Kindred,” “we,” “us”). They govern your access to and use of the Kindred Voice beta service, including the /try experience and any agent you create using it (together, the “Beta Service”).
By checking the box marked “I agree to the Terms of Service and Privacy Policy,” creating an account, or using the Beta Service, you accept these Terms. If you do not agree, do not create an account.
Our Privacy Policy describes how we handle your information and forms part of these Terms.
2. Eligibility
2.1 Age. You must be at least 18 years old.
2.2 Business use. The Beta Service is offered for business and professional evaluation. It is not intended for personal, household, or consumer purposes.
2.3 Location. The Beta Service is offered only to users located in the United States and Canada. You may not access it from outside those countries.
2.4 Authority. If you accept these Terms on behalf of a company or other organization, you represent that you have authority to bind it, and “you” refers to that organization.
3. What the Beta Service is — and what it is not
Please read this section carefully. It describes real limits on the Beta Service.
3.1 No telephone calls. The Beta Service does not place or receive telephone calls. Agents you create in the beta cannot dial out and cannot be reached by an inbound call. Any telephony capability described in our marketing materials or offered in our commercial products is not part of the Beta Service.
3.2 Your agents are private to your account. Agents you create can only be accessed by someone signed in to the account that created them. There is no sharing link, public URL, or other way to expose an agent to a person who is not logged in to your account.
3.3 Beta software. The Beta Service is pre-release. It may contain errors, produce inaccurate or unexpected output, become unavailable without warning, or change substantially. It is provided for evaluation only and should not be relied upon for any production, operational, or business-critical purpose.
3.4 No service levels. We make no uptime, availability, response-time, or support commitments for the Beta Service.
3.5 We may change or discontinue it. We may modify, suspend, or discontinue the Beta Service, in whole or in part, at any time and without notice or liability.
3.6 Your data may be deleted. We may delete agents, transcripts, and other content in the Beta Service at any time, including when the beta ends. Do not use the Beta Service as your only copy of anything you need to keep. See §9 and our Privacy Policy for retention details.
4. Your account
4.1 You must provide an accurate email address and choose a password. You are responsible for keeping your password confidential.
4.2 You are responsible for all activity under your account. Notify us promptly at info@kindredvoice.ai if you believe your account has been accessed without your authorization.
4.3 One person or organization per account. Do not share your credentials.
5. Acceptable use
You agree not to do any of the following.
5.1 Sensitive information — please read
Do not speak, type, upload, or otherwise submit any of the following to the Beta Service:
- Protected health information or any information subject to HIPAA;
- Payment card numbers, financial account numbers, or account credentials;
- Government identifiers, including Social Security numbers, passport numbers, driver's license numbers, or tax identification numbers;
- Biometric identifiers or biometric information of any person;
- Personal information about other people — including your customers, clients, patients, tenants, or employees — whether or not it falls into the categories above.
The Beta Service is for evaluation. Please use fictional or example information when testing. It is not designed, secured, or certified for regulated or sensitive data, and we do not want to receive it.
Kindred is not acting as a HIPAA business associate and will not execute a business associate agreement in connection with the Beta Service. The Beta Service is not within the scope of PCI DSS. If you submit information of a kind prohibited by this section, you do so in breach of these Terms and at your own risk.
5.2 Voices. Do not submit any person's voice for cloning, imitation, or synthesis without that person's consent.
5.3 Harmful use. Do not use the Beta Service to create, facilitate, or attempt any of the following: harassment, threats, or abuse; fraud, deception, or impersonation of a real person or organization; unlawful discrimination; or any other unlawful activity.
5.4 Technical restrictions. Do not: reverse engineer, decompile, or attempt to derive the source code or underlying models of the Beta Service; access it by automated means except as we expressly permit; circumvent authentication, rate limits, or usage restrictions; probe or test the vulnerability of any system without our prior written consent; resell, sublicense, or provide the Beta Service to any third party; or use it to build a competing product or service.
5.5 Consequences. We may suspend or terminate your access immediately, without notice, if we believe you have violated this section.
6. Your content
6.1 What we mean. “Your Content” means the agent configurations you create, the text you enter, the speech you provide as input, and the transcripts generated from that speech.
6.2 You own it. As between you and Kindred, you retain all rights in Your Content. These Terms do not transfer ownership of Your Content to us.
6.3 The license you give us. You grant Kindred a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely to operate, secure, support, and maintain the Beta Service for you. This license exists so that we can run the product; it ends when Your Content is deleted, except for backups retained for the limited period described in our Privacy Policy.
6.4 We do not train on Your Content. We do not use Your Content — including your transcripts — to train, fine-tune, or improve artificial intelligence models. We have configured our third-party AI providers on service tiers under which they likewise do not train on content submitted through our accounts. See §7.
6.5 Your responsibility. You represent that you have the rights necessary to submit Your Content and that it does not violate §5 or infringe anyone's rights.
7. Third-party AI providers
The Beta Service works by sending your input to third-party artificial intelligence providers for processing. This includes your speech: when you talk to an agent, your audio is transmitted to and processed by those providers in real time in order to generate a text transcript.
We do not store or retain the audio recording. We do retain the transcript.
Our Privacy Policy identifies these providers and explains this in more detail. Your use of the Beta Service constitutes your instruction to us to transmit Your Content to them for this purpose.
8. Feedback
If you send us suggestions, ideas, bug reports, or other feedback about the Beta Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use it for any purpose without obligation or compensation to you. Please do not send us feedback you consider confidential.
9. Term, termination, and what happens to your data
9.1 These Terms apply from the moment you accept them until terminated.
9.2 You may stop using the Beta Service and delete your account at any time.
9.3 We may suspend or terminate your access at any time, with or without cause, and without notice.
9.4 On termination, your right to use the Beta Service ends immediately. We will delete or de-identify Your Content in accordance with the retention periods in our Privacy Policy.
9.5 Sections 5, 6.2, 6.5, 8, 10, 11, 12, and 14 survive termination.
10. Disclaimers
The Beta Service is provided “as is” and “as available,” with all faults and without warranty of any kind. To the fullest extent permitted by law, Kindred disclaims all warranties, express, implied, and statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, we do not warrant that the Beta Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any output — including transcripts and agent responses — will be accurate, complete, or suitable for any purpose.
AI output can be wrong. Transcripts may misrepresent what was said. Agent responses may be inaccurate or inappropriate. Do not rely on the Beta Service's output without independent verification.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law:
11.1 Kindred will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Beta Service, whether in contract, tort, or any other theory, even if we have been advised of the possibility.
11.2 Kindred's total aggregate liability arising out of or relating to these Terms or the Beta Service will not exceed one hundred U.S. dollars (US$100).
11.3 You acknowledge that the Beta Service is provided free of charge and that these limitations are a fundamental basis of the bargain between us.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
12. Indemnification
You will defend, indemnify, and hold harmless Kindred and its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) Your Content; (b) your use of the Beta Service; (c) your breach of these Terms, including any submission of information prohibited by §5.1; or (d) your violation of any law or third-party right.
13. Changes to these Terms
We may update these Terms. If we make a material change, we will notify you by email to the address on your account or by a notice in the Beta Service before the change takes effect. Each version is dated, and continuing to use the Beta Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Beta Service and delete your account.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and Kindred submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware, and each of us waives any objection to venue there.
15. General
15.1 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Kindred regarding the Beta Service and supersede any prior discussions.
15.2 Severability. If any provision is held unenforceable, the rest remains in effect.
15.3 No waiver. Our failure to enforce a provision is not a waiver of it.
15.4 Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
15.5 Notices. We may give notice to the email address on your account. You may give notice to us at the address below.
15.6 Relationship. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
